Delegation of Authority to the Butner Town Manager

Purpose

The purpose of this Directive is to delegate, clarify and specifically confirm certain authorities of the Secretary of the Department of Health and Human Services to the Butner Town Manager. North Carolina General Statute 122C-403 provides that the Secretary of the Department of Health and Human Services shall administer the Camp Butner reservation. This Directive delegates administrative and other duties regarding the Town of Butner to the Butner Town Manager. Due to the presence of significant Department property in Butner, the Town Manager shall report to the Deputy Secretary through the Director of the Office of Property and Construction.

Delegation of Authority

As provided in G.S. 143B-10(a), the Secretary of the Department of Health and Human Services delegates the following functions and responsibilities with respect to the administration of the Camp Butner reservation to the Butner Town Manager:

  1. The authorities specifically relating to the Camp Butner reservation contained in NCGS Section 122C-403 (1) through (8).


  2. The powers and duties of a town manager as contained in NCGS 160A-148.


  3. The responsibility of representing the Secretary of Health and Human Services in maintaining positive working relationships with other local governmental units.


  4. The Town Manager shall be the Secretary's liaison to the Butner Advisory Council.


  5. The Town Manager shall be familiar with and adhere to the Department's Policy and Procedures Manual.

This delegation of authority shall not deprive the Secretary from performing, in lieu of the Town Manager, any of the acts set forth above. This delegation of authority may be amended or withdrawn by the Secretary at any time and without notice. This delegation of authority shall not apply to any actions which by law, state policy, or Governor's Executive Order, may only be executed by the Secretary.
