CHANGE NOTICE FOR MANUAL
MANUAL: Food Stamp Certification Manual
CHANGE NO.: 8-2002 Date March 25, 2002
TO: County Directors of Social Services
EFFECTIVE April 1, 2002, make the following changes to the Food Stamp Certification Manual.
I. BACKGROUND
The purpose of this change notice is to provide a new exemption from sponsored alien requirements as outlined in the Code of Regulations in 273.4(c)(3)(iv).
II. SPECIFIC CHANGES
A. Section 225, United States Citizenship and Alien Status
• Exempts certain eligible aliens from the sponsored alien requirements if the sponsored alien is indigent.
• An eligible sponsored alien is indigent if the sum of all the sponsored alien's household income and any assistance the sponsor or others provide (cash or in-kind) is less than or equal to 130 percent of the poverty income guideline
• Unlike normal determination of income for food stamp eligibility purposes, the indigence determination includes an estimation of the value of in-kind assistance the sponsor and others provide.
• The county would determine the amount of income and other in-kind assistance provided in the month of application.
• Each indigence determination is for 12 months and is renewable for additional 12-month periods.
• If the sponsored alien is indigent, count in the budget the actual cash contributions the sponsor and others provide.
• Contact the US Attorney General in writing when an indigent determination is made.
III. IMPLEMENTATION INSTRUCTIONS
These changes are effective with each application, change in situation, or recertification taken or processed after April 1, 2002.
