CHANGE NOTICE FOR MANUAL

MANUAL: Food Stamp Certification Manual
CHANGE NO.: 12-2003 Date: August 25, 2003
TO: County Directors of Social Services
EFFECTIVE September 1, 2003, make the following changes to the Food Stamp Certification Manual.
I. BACKGROUND
This change identifies specific INS (Immigration and Naturalization Service) and EOIR (Executive Office of Immigration Review) documentation needed to verify qualified status for battered aliens. Eligibility rules requiring the applicant to maintain a separate residence from the batterer prior to receipt of benefits are clarified.
This change converts all references to the Immigration and Naturalization Service (INS) to it’s new title, the Bureau of Citizenship and Immigration Services (BCIS), and references to the Economic Independence Section to Adult and Economic Services Section.
II. SPECIFIC CHANGES
A. Section 225.04, Determine Alien Status And Eligibility For Food Stamp Benefits
Adds additional specific documents needed to verify qualified status for battered aliens to the document/alien status chart.
B. Section 225.05,A, Determining Alien Eligibility
Removes battered alien status from the list of eligibility criteria.
C. Section 225.05,B, Exceptions to Qualified Alien Process
1. Adds additional (INS and EOIR) documentation that can be used to verify qualified status for battered aliens.
2. Clarifies that although a battered alien may not receive benefits while they are living with the batterer, the applicant may need some assurance of availability of benefits in order to leave. The application must be taken even if the applicant is still living with the batterer, allowing final verification of a new residence prior to the receipt of benefits.
3. Specifies that custodial parents of a qualified battered immigrant or U.S. citizen child are also eligible for food stamp benefits.
III. IMPLEMENTATION INSTRUCTIONS
This change is effective September 1, 2003.
