Make the following change(s)
The Division of Medical Assistance (DMA) periodically revises the current average private Nursing Facility rate.
The current average private Nursing Facility rate changed from $5,000 to $5,500 per month and $166 to $177 daily. This figure is used to calculate sanctions for transfers of assets for less than fair market value.
Apply the new average private nursing facility rate of $5,500 when determining sanction periods for transfer of resources when the applicant/recipient requests nursing home assistance, CAP, Long Term Care or in home services on or after December 1, 2009. When the application date is prior to December 1, 2009, use the old amount of $5,000. Also apply this policy to any transfers that occur on or after December 1, 2009 in which a recipient is not currently under sanction.

Insert: MA-2240, Transfer of Assets, pages 33-34, 39-40, and 41-42.
