Administrative Letter 01-10 informed the counties that, as a result of a court decision, North Carolina must use family size budgeting when determining eligibility for MQB cases. Family size budgeting compares countable income to the maintenance level for the family, which includes the a/r, the spouse if there is one, and any dependent children under age 18 living in the home.
SSI budgeting methodology remains the correct method of determining eligibility for MAABD cases. SSI budgeting is the methodology that has been in use since January of 1995. Although MAABD budgeting is not affected by the court ruling, budgeting for dual eligibles is impacted by the change in methodology.
The system changes needed to accommodate more MQB maintenance levels and income limits for MAABD and MQB dual eligibles cannot be made at this time. Nevertheless, we must continue to comply with the court ruling.
MA-2260, Financial Eligibility Regulations – PLA, is revised to include the instructions for processing MQB cases that were originally outlined in Administrative Letter 01-10. The incorporation of MQB Family Size Budgeting necessitated a reorganization of the entire section.
This manual change does not represent a change in policy; it is merely puts the policy outlined in Administrative Letter 01-10 into the manual. Upon receipt of this Change Notice, refer to MA-2260, Financial Eligibility Regulations – PLA, for guidance and instructions in processing MQB cases.
